1. Purpose
These Terms of Use (the “Terms”) govern access to and use of:
- the EPIC PERSONA® website;
- the online test;
- the related user areas; and
- the free content made available on the website.
They apply to any person who visits the website or uses the service, whether or not that person has an account.
2. Publisher
The EPIC PERSONA® service is published by FRANCE PLAIDOYER, as identified in the Legal Notice.
3. Acceptance of the Terms
Access to and use of the website imply acceptance of these Terms.
Where certain features require a specific action by the user (for example, creating an account, accessing a personal area, purchasing premium content, or submitting a form), additional terms may also apply.
4. Who Is EPIC PERSONA® For?
The website is intended for:
- the general public;
- individual users;
- business users, within the limits set out on the website; and
- users located in France, the European Union, and, more broadly, internationally, subject to locally applicable laws.
A minor may use the paid service only if the minor has the required legal capacity or acts through a legal representative where required by applicable law.
5. What EPIC PERSONA® Is
EPIC PERSONA® offers a power assessment intended to provide information about how a person makes decisions and acts, particularly within a constrained system or when the stakes increase.
The test and the related content are based on a proprietary method and algorithm.
6. What EPIC PERSONA® Is Not
Except as expressly stated otherwise, EPIC PERSONA®:
- is not a medical device;
- is not a clinical psychological test;
- is not individualized legal, HR, or management advice; and
- does not guarantee any performance or any personal, professional, academic, psychological, or economic outcome.
The results, analyses, and content must be understood as tools for insight and reflection, and not as an absolute truth.
7. Limits on the Use of Results
Test results must not be used as the basis for an important decision concerning a person, including:
- a hiring decision;
- the rejection of an application;
- a performance evaluation;
- a disciplinary measure;
- a career-management decision; or
- any other sensitive decision concerning the person.
In recruiting, management, coaching, team-building, or support contexts, the results must remain one decision-support element among others.
8. Access to the Free Test
The free test is accessible in accordance with the technical arrangements made available on the website at the time of use.
The user understands that:
- access to the free test does not guarantee access to all analyses;
- certain features may require an account; and
- certain data may be requested in order to save a result, send it by email, or link that result to a user account.
9. User Account
Certain features of the service require the creation or use of a personal account.
The user agrees to:
- provide accurate and up-to-date information;
- not impersonate any third party;
- keep login credentials and authentication methods confidential; and
- promptly notify the publisher of any unauthorized use of the user’s account.
The account is personal. Unless FRANCE PLAIDOYER has given prior written authorization, it may not be shared, assigned, or made available to any third party.
10. Prohibited Conduct
In particular, the following are prohibited:
- using the service for purposes other than those for which it is intended;
- bypassing the website’s technical limitations;
- automating use of the service in an abusive manner;
- scraping, harvesting, or extracting content or data in bulk;
- copying or reproducing the questions, the method, the herotypes, the reports, or the premium content;
- training an artificial intelligence model on the website content or reports without authorization;
- reverse engineering, attempting to reconstruct the algorithm, or compromising the security of the service;
- sharing an account with a third party;
- publishing or distributing all or part of the premium report without authorization; or
- using the service for unlawful, misleading, defamatory, or competitive purposes.
11. Free Result and Sharing
The user may freely share the user’s free result under the user’s sole responsibility, provided that doing so does not misrepresent the service or infringe the rights of FRANCE PLAIDOYER or of any third party.
By contrast, the full premium report is personal and is not intended to be shared, reproduced, distributed, or used beyond personal use, unless prior written authorization has been obtained.
12. Professional Uses and Support Services
At this time, supervised professional use of the service in connection with support services, coaching, training, or team analysis may be reserved to FRANCE PLAIDOYER or to practitioners / coaches who are certified or otherwise authorized under a separate contractual arrangement.
Where applicable, specific B2B or professional terms will supplement or replace these Terms for such uses.
13. Changes to the Service
The service, the test, the herotypes, the content, the features, the user journeys, and the analyses may change over time.
FRANCE PLAIDOYER may:
- correct;
- modify;
- enhance;
- suspend; or
- remove
all or any part of the service, in particular for technical, editorial, security, legal, or economic reasons.
14. Availability
FRANCE PLAIDOYER uses reasonable efforts to ensure the accessibility of the website.
However, the website may be interrupted or slowed down, in particular in the event of:
- maintenance;
- updates;
- a technical incident;
- overload;
- an external event; or
- a legal or security requirement.
16. Intellectual Property
All intellectual property rights in the EPIC PERSONA® website and service remain the exclusive property of FRANCE PLAIDOYER or its rights holders.
No ownership rights are transferred to the user solely as a result of access to the website or use of the service.
17. Suspension or Termination of Access
FRANCE PLAIDOYER may suspend, restrict, or terminate a user’s access, without prejudice to any claim for damages, in particular in the event of:
- a breach of these Terms;
- fraud or attempted fraud;
- abusive use or misuse;
- infringement of intellectual property rights;
- interference with the operation or security of the service; or
- a legal or regulatory obligation.
In the event of a serious breach, such action may be taken without prior notice.
18. Liability
FRANCE PLAIDOYER undertakes a general obligation to use reasonable efforts in operating the website.
To the extent permitted by law, FRANCE PLAIDOYER shall not be liable for:
- personal or professional choices made by a user on the basis of the results;
- a subjective or excessive interpretation of a result;
- any use of the service that does not comply with these Terms;
- any indirect, non-material, or consequential damages;
- temporary unavailability of the website; or
- malfunctions attributable to a third party or to the user’s technical environment.
This clause does not deprive consumers of any mandatory legal guarantees applicable to them.
19. Amendments to the Terms
These Terms may be amended at any time.
The applicable version is the version published on the website on the date of the relevant use, subject to any specific provisions applicable to a purchase or an account.
20. Governing Law and Jurisdiction
These Terms are governed by French law, subject to any mandatory protective provisions applicable in the consumer’s country of residence.
In the event of a dispute with a business user, exclusive jurisdiction is vested in the courts with territorial jurisdiction over the registered office of FRANCE PLAIDOYER, unless mandatory law provides otherwise.
