General Terms and Conditions of Sale - EPIC PERSONA® Premium (B2C)

1. Purpose

These general terms and conditions of sale (the "GTCS") govern the distance sale, through the EPIC PERSONA® website, of access to the EPIC PERSONA® premium report for consumers.

They supplement:

• the website Terms of Use;
• the Legal Notice;
• the Privacy Policy;
• the Cookie Policy.

2. Seller

3. Scope of Application

These GTCS apply to purchases made by consumers, meaning natural persons acting for purposes that do not fall within the scope of their commercial, industrial, craft, professional, or agricultural activity.

Specific terms may later be published for:

• B2B customers;
• EPIC PERSONA®-certified coaches or practitioners;
• regulated professional uses.

4. Essential Characteristics of the Premium Service

The EPIC PERSONA® premium offer provides access to premium digital content linked to the purchaser's account, including in particular:

• an in-depth report of more than 30 pages;
• additional analyses related to the herotype obtained;
• secondary characteristics and elements not displayed in the free tier;
• recommendations and comparative analyses with other herotypes;
• online access to the report for 5 years from the date of payment;
• the option to retake the test during the 6 months following payment, without an additional purchase.

If a new test is taken within this 6-month period following payment, the premium report is updated and replaces the previous report.

5. Nature of the Rights Granted

The purchase grants the purchaser a right that is:

• personal;
• non-transferable;
• non-exclusive;
• linked to the purchaser's EPIC PERSONA® account;
• limited to the duration provided for in these GTCS.

The premium offer is sold individually. Purchase on behalf of a third party is not permitted under these GTCS.

6. Access Conditions

Access to the premium report requires:

• validated payment;
• the existence of a user account or a technical linking of the result to an account;
• compliance with the Terms of Use;
• the technical availability of the service.

Access to the premium service begins after payment confirmation and technical activation of the access right.

7. Price

The reference price of the premium offer is EUR 29 incl. VAT.

Depending on the country, payment may be presented in another currency through the payment interface, using a pricing equivalence based on this reference price, tax included or net of taxes.

Unless otherwise stated at the time of ordering, the price displayed before final validation of the order is the price due.

8. Order

The order is placed online.

Before final validation, the customer is provided with a summary allowing the customer to verify the essential elements of the order, including in particular:

• the nature of the premium content purchased;
• the price;
• the fact that the order is subject to payment;
• these GTCS;
• information relating to the right of withdrawal or, where applicable, to its waiver and loss.

Validation of the order entails an obligation to pay.

9. Payment

Payment is made through Stripe.

The customer represents and warrants that he or she has the necessary authorizations to use the selected method of payment.

FRANCE PLAIDOYER does not store full bank card data; payment is processed through the payment service provider's infrastructure.

10. Contract Confirmation

After the contract is concluded, a confirmation must be provided to the customer on a durable medium, including the required contractual information and, where applicable, confirmation of the customer's consent to immediate performance and acknowledgment of the loss of the right of withdrawal.

11. Performance and Availability

The premium report is digital content provided online.

FRANCE PLAIDOYER undertakes to provide the premium content after payment, subject to:

• proper operation of the platform;
• technical availability of the systems;
• the customer's compliance with the access conditions.

In the event of a technical incident preventing access to the report after payment, FRANCE PLAIDOYER may, as a matter of priority:

1. restore access;
2. correct the incident;
3. failing that, review an appropriate solution, including a refund where required.

12. Right of Withdrawal

12.1 General Rule

Where permitted by law, the consumer generally benefits from a 14-day withdrawal period for contracts concluded at a distance.

12.2 Special Case of EPIC PERSONA® Premium Digital Content

The EPIC PERSONA® premium report constitutes digital content not supplied on a tangible medium, the performance of which begins immediately after payment when the customer requests immediate access.

In that case, the customer:

• expressly requests immediate performance of the contract before expiration of the withdrawal period; and
• expressly acknowledges that he or she loses the right of withdrawal once the legal conditions are satisfied.

Accordingly, no refund is provided if the premium report has already been made accessible.

13. Minors

The premium service is available only to persons with legal capacity to contract or, where required by applicable law, through their legal representative.

It is the responsibility of the user and, where applicable, the user's legal representative, to verify the lawfulness of the purchase in light of their situation and applicable local regulations.

14. Use of the Premium Report

The premium report is intended for the customer's personal use.

Unless FRANCE PLAIDOYER has given prior written authorization, the customer may not:

• share access;
• resell or assign the report;
• reproduce or distribute the report on a large scale;
• use it within a structured professional framework requiring a separate contract or certification;
• present it as certain medical, psychological, legal, or HR advice.

Sharing of the free result remains permitted under the user's responsibility; the full premium report is not intended to be shared.

15. Sensitive Uses and Limitations

The customer acknowledges that the EPIC PERSONA® service constitutes an analytical and informational tool, and not an absolute truth.

The premium report must not be used as the basis for:

• a hiring decision;
• the rejection of an application;
• a performance evaluation;
• a disciplinary action;
• a sensitive decision concerning a person.

16. Statutory Warranties Applicable to Digital Content and Digital Services

Consumers benefit, where the legal conditions are satisfied, from the provisions of the French Consumer Code relating to digital content and digital services, particularly with respect to conformity.

Any statutory rights of the consumer apply notwithstanding any contrary clause in these GTCS.

17. Liability

FRANCE PLAIDOYER is bound by a duty of reasonable efforts in providing the service.

To the extent permitted by law, FRANCE PLAIDOYER shall not be held liable for:

• the customer's use of the report;
• decisions made on that basis;
• indirect damages;
• temporary unavailability due to technical issues, networks, third parties, or maintenance.

Nothing in these GTCS shall have the effect of excluding or limiting the consumer's mandatory rights.

19. Consumer Mediation

In accordance with applicable law, the consumer may have free recourse to a consumer mediator for the amicable resolution of a dispute.

20. Amendments to the GTCS

FRANCE PLAIDOYER may amend these GTCS.

The version applicable to the order is the version accepted by the customer at the time of purchase.

21. Governing Law

These GTCS are governed by French law, subject to the mandatory protective provisions applicable in the consumer's country of residence.

22. Future B2B / Coach Clauses

Separate terms may later be published for:

• B2B customers;
• executives and organizations;
• certified coaches or practitioners.

23. Practical Summary

What are you buying?

Personal access to an EPIC PERSONA® premium report.

For how long?

5 years of access to the report, plus a 6-month retake period from the date of payment.

Can I buy it for someone else?

No, not under this offer.

Can I share the premium report?

No, unless prior written authorization has been given.

Can I withdraw?

Unfortunately no, as immediate access to the premium digital content is given, it's not possible to withdraw.
